Terms of Service
Company Information & Payments:Fifth House Photos may be contacted via the website contact form or at Studio@fifthhousephotos.com. Payments are accepted through Squarespace Payments and cash. Booking through the website secures a deposit only. The remaining balance shall be paid in accordance with the payment schedule agreed upon at booking, with full payment due at or before the time of the scheduled session.
Clients under eighteen (18) years of age must have a parent or legal guardian sign all contracts and model releases.
Late Payment Policy:Payments not received by the agreed due date shall incur a late fee of five percent (5%) of the outstanding balance per week, not to exceed one hundred dollars ($100) in total.
Copyright & Usage:All photographs remain the sole intellectual property of the Photographer. The Client is granted a non-exclusive, non-transferable license for personal use only, including printing and sharing on personal social media. The Client may not sell, alter, or use the images for commercial purposes without prior written consent from the Photographer. Unless otherwise agreed in writing, the Photographer retains the right to use images for portfolio, marketing, and promotional purposes.
Editing & Delivery:Final images will be delivered via a digital gallery. Only edited images will be provided. RAW or unedited files will not be delivered under any circumstances.
Creative Control:The Client acknowledges that the Photographer’s work is based on artistic style, judgment, and discretion. While preferences may be discussed in advance, the Photographer retains full creative control over image selection and editing. The final gallery represents the Photographer’s artistic interpretation and is not subject to revision after delivery.
Additional Editing Requests:Requests for additional edits beyond standard processing may be subject to additional fees, determined at the Photographer’s sole discretion. Included edits may consist of minor adjustments such as lighting, color correction, removal of temporary distractions, and styling-related fixes. The Photographer does not perform alterations that change the Client’s natural physical features.
Turnaround Time:Delivery of the final gallery is estimated within two (2) weeks. The Photographer reserves the right to extend this timeframe due to circumstances including but not limited to illness, emergency, or additional editing requirements. Any delays will be communicated promptly.
File Retention:Client images will be retained for up to six (6) months following delivery. The Photographer is not responsible for maintaining archives beyond this period. Clients are solely responsible for backing up their files.
Second Shooter:The Photographer may utilize a second shooter or assistant. All images produced remain the exclusive property of the Photographer and are governed by this Agreement. The Client will receive a single curated gallery and holds no separate agreement with any second shooter.
Limitation of Liability:The Photographer shall not be held liable for any injury, loss, or damage arising during the session except in cases of gross negligence or willful misconduct. In the event the Photographer is unable to perform due to equipment failure or unforeseen circumstances, liability shall be limited to a full refund of all payments received.
Governing Law & Dispute Resolution:This Agreement shall be governed by the laws of the State of Tennessee. The parties agree to attempt resolution of any dispute through good faith negotiation or mediation prior to initiating legal action. Any legal proceedings shall be brought in a court of competent jurisdiction in Hawkins County, Tennessee. The prevailing party shall be entitled to reasonable attorney’s fees and court costs.
Client Responsibilities:The Client agrees to arrive on time and prepared for the session. The Client is responsible for obtaining any required permits or permissions for chosen locations. The Photographer is not responsible for missed images due to lateness or lack of cooperation.
